Illinois Ruling a Victory for Second Amendment

STATE’S HIGH COURT REVERSES LAWSUIT DISMISSAL . . . The Illinois Supreme Court on Thursday reversed a trial court’s dismissal of a lawsuit challenging Cook County’s so-called “assault weapons” ordinance banning certain commonly owned and widely used semi-automatic firearms, including modern sporting rifles — a decision NSSF calls a victory for the Second Amendment. NSSF sets the record straight in a blog post today.
  • CANADIAN LONG-GUN REGISTRY ‘FINALLY DESTINED FOR SCRAP HEAP’ . . . “Good riddance to the long-gun registry — possibly the most unfair and useless legislation ever to have been passed by Parliament of Canada,” reads a press release sent Thursday by the Canadian Shooting Sports Association. California could learn from Canada’s mistake. Despite Canada’s example of such legislation being not only ineffective and costly, but also an erosion of personal freedom, California passed its own long-gun registration law in the fall of 2011.
  • TV NEWS REPORT ON MULTIPLE SALES REPORTING REQUIREMENT . . . East Texas’ NBC-affiliate KETK last week featured a TV news report on ATF’s controversial reporting requirement for multiple sales of long guns in Southwest border states. NSSF filed a lawsuit in August challenging the requirement.

  • NSSF SET TO SPONSOR NATIONAL HUNTING AND FISHING DAY . . . NSSF will once again renew its major sponsorship of National Hunting and Fishing Day, the official federal commemoration of hunters, anglers and conservation. NSSF has been involved with National Hunting and Fishing Day for 41 years. NHF Day continues to grow and reach new outdoorsmen and outdoorswomen each year with the continued support of its sponsors. With virtually no public notice or legislative debate, a centerpiece of ex-Gov. George Pataki’s controversial multimillion-dollar anti-gun-crime program was shot dead Friday by Gov. Cuomo’s new state budget.

The budget killed off the so-called CoBis, or Combined Ballistics Identification System, which was rolled out with much fanfare by Pataki in 2000 in what was widely seen as an attempt by the politically ambitious Republican “moderate’’ to appeal to anti-gun Democrats nationally, possibly for a future presidential run.

Pataki claimed CoBis would use state-of-the-art technology to establish a “DNA database for handguns’’ by requiring manufacturers of new semiautomatic pistols to file spent cartridge shells with the State Police, so that their markings could be kept in a traceable registry and compared to any found at crime scenes.

Many Democrats praised the program, and even then-First Lady Hillary Rodham Clinton, running for the US Senate in New York, praised Pataki for showing “real leadership in proposing a state-based ballistics program . . . something that needs to be done on a national level.’’

Trouble is, the Pataki program NEVER worked. Despite the hundreds of thousands of spent shells submitted, not one criminal was ever captured using the extensive and costly-to-maintain database, state officials concede.

“We are ending a program that doesn’t solve crimes or make our streets safe,’’ said Cuomo spokesman Josh Vlasto.

“That’s what we said would happen from the start,’’ crowed Tom King, president of the New York Rifle and Pistol Association and a National Rifle Association board member. “I think Andrew Cuomo is a very intelligent guy who didn’t want to waste money, and this wasn’t working.”

Vlasto said CoBis cost about $1.2 million a year, but King said it was more like $40 million because of equipment, staff and related expenditures to get the system up and running.

Vlasto said the state would shift at least some of its CoBis spending to the federal National Integrated Ballistic Information Network, which tracks spent shells from guns used in crimes and not simply from those that were legally sold.

Ending CoBis is expected to strengthen the argument against another controversial anti-gun- crime technology, microstamping, which requires gun makers to install a device to put ID marks on spent cartridge shells.

Cuomo backs microstamping, but didn’t fight to put it in the budget. It was backed by the Democratic-controlled Assembly but blocked by the GOP-led Senate.

King and other foes contend that, like CoBis, it won’t work because the technology targets legal gun owners, who are rarely involved in crimes, and is unproven, easily circumvented and worthless for revolvers (which don’t eject spent shells).

Bitter state Senate Democrats, split for years by racial, regional and personal divisions, engaged in a new round of political fratricide Friday over whether to vote for Cuomo’s new budget.

“The opponents were saying it’s a bad budget because it doesn’t include enough spending, a New York Dream Act [aid for illegal aliens], microstamping or a [gas-drilling] hydrofracking health study, and they said Democrats shouldn’t vote for it along with the Senate’s majority Republicans,’’ said a Senate source.

While the Democrats eventually decided overwhelmingly to back the spending plan, there was a bigger issue involved — continuing fury over Cuomo’s decision to sign the controversial legislative-redistricting plan that gerrymandered Senate lines heavily in the GOP’s favor.

“Our leadership doesn’t see the governor as part of the team. They don’t trust him, and they don’t have good feelings about him,’’ said a prominent Democratic senator who demanded anonymity.

about 20 million dissidents, unable to defend themselves, were rounded
up and exterminated.

In his last official act of business in 2011, President Barack Obama signed the National Defense Authorization Act from his vacation rental in Kailua, Hawaii. In a statement, the president said he did so with reservations about key provisions in the law — including a controversial component that would allow the military to indefinitely detain terror suspects, including American citizens arrested in the United States, without charge.

The legislation has drawn severe criticism from civil liberties groups, many Democrats, along with Republican presidential candidate Ron Paul, who called it “a slip into tyranny.” Recently two retired four-star Marine generals called on the president to veto the bill in a New York Times op-ed, deeming it “misguided and unnecessary.”

“Due process would be a thing of the past,” wrote Gens Charles C. Krulak and Joseph P. Hoar. “Current law empowers the military to detain people caught on the battlefield, but this provision would expand the battlefield to include the United States – and hand Osama bin Laden an unearned victory long after his well-earned demise.”

The president defended his action, writing that he signed the act, “chiefly because it authorizes funding for the defense of the United States and its interests abroad, crucial services for service members and their families, and vital national security programs that must be renewed.”

Senior administration officials, who asked not to be named, told ABC News, “The president strongly believes that to detain American citizens in military custody infinitely without trial, would be a break with our traditions and values as a nation, and wants to make sure that any type of authorization coming from congress, complies with our Constitution, our rules of war and any applicable laws.”

One official explained that President Obama does believe, however, that American citizens can be temporarily detained, and that the military has the right to capture and hold any citizen who is engaged in conflict against the United States. If various provisions in the law prove unworkable, the president could go back to Congress to ask for changes.

“The president is going to adhere to the policies that he has held over the last three years, making sure that none of these congressional provisions impede the ability of the counterterrorism and military professional from keeping the country safe,” the official said.

This week the FBI released data  showing that violent crime in the United States fell 6.4 percent in the first half of this year compared to the same time period in 2010.  The data also indicated a 3.7 percent drop in property crime.
The FBI statistics undermine a favorite argument of anti-gun groups and some mainstream media that “more guns equal more crime,” especially when you consider that the continuing decrease in violent crime parallels record firearm sales.

According to the National Instant Criminal Background Check System (NICS), a primary source for how industry and analysts gauge firearm sales, this past November marked the eighteenth-straight month that NICS figures increased when compared to the same period of the previous year. Furthermore, this past “Black Friday” (November 25, 2011) set a record for the most background checks for firearm purchases in a single day (129,166), with a 32 percent increase over the previous single day high.  This milestone was followed by the release of the NSSF-adjusted NICS figures for November 2011 that showed an increase of 16.5 percent over the same month last year.

Of course, there remain two additional statistics that likewise enjoy a symbiotic relationship to America’s decreasing crime rate and growing firearms population, our continuing decline in firearm-related accidentsand the record lack of public support for gun control.  Clearly more and more law-abiding citizens are choosing to exercise their Second Amendment right to keep and bear arms, and they’re doing so in a safe and responsible manner. This fact, coupled with the empirical data demonstrating a correlation between increased firearms ownership and decreased crime levels, is something we can all be thankful for this holiday season.
